This page (together with the documents
referred to on it) tells you the terms and conditions on which you, the Corporate Superuser (‘you’),
may make use of our website www.marhabaservices.com
(the ‘Website’) and the online booking engine (the ‘Booking Engine’)
contained on our Website. Please read
these terms and conditions carefully before you start to use the Website. By
using our Website, you indicate that you accept these terms and conditions on
behalf of yourself and any sub-user authorised by you to use the Website under
your corporate account and password and that you and they agree to abide by
them. If you do not agree to these terms and conditions, please refrain from
using our Website and the Booking Engine.
Company Information
This Website is owned by Marhaba Services (a
division of Dnata) and is operated by Dnata (‘we’, ‘us’), for and on behalf of Marhaba
Services. Dnata is a Dubai
corporation established by Decree No.1 of 1987 of the Government of Dubai (as
amended), having its principal place of business at Emirates Group Headquarters
Building, P.O. Box 1515, Dubai, United Arab Emirates.
Your Account
You
are responsible for maintaining the confidentiality of your corporate account
and password and for preventing unauthorised access to your account. You agree
to accept responsibility for all activities that occur under your corporate account
or password. You must take all necessary steps to restrict access to the
Website and to your password only to sub-users authorised by you and you should
inform us immediately if you have any reason to believe that your password has
become known to anyone else, or if the password is being, or is likely to be,
used in an unauthorised manner.
We
reserve the right to refuse access to the Website and/or the Booking Engine,
terminate/disable accounts, remove or edit content, or cancel bookings made
through the Booking Engine at our discretion.
Access
We
will do our utmost to ensure that availability of the Booking Engine and the
Website will be uninterrupted and that transmissions will be error-free.
However, due to the nature of the Internet, this cannot be guaranteed and we
reserve the right to withdraw or amend access to the Booking Engine on the
Website without notice. Your access to the Website or the Booking Engine may
also be occasionally suspended or restricted to allow for repairs, maintenance,
or the introduction of new facilities or services. We will attempt to limit the
frequency and duration of any such suspension or restriction. For the avoidance of doubt we will not be
liable if for any reason our Website or the Booking Engine is unavailable at
any time or period.
Acceptable Use
We
grant you a limited licence to access and make use of this Website and the
Booking Engine for the purpose of making bookings for Marhaba Services, but not
to download (other than page caching) or modify it, or any portion of it,
except with our express written consent. This licence does not include any
derivative use of this Website or the Booking Engine or its contents; any
downloading or copying of account information; or any use of data mining,
robots, or similar data gathering and extraction tools.
This
Website and the Booking Engine or any portion of this Website or the Booking
Engine may not be reproduced, duplicated, copied, sold, resold, visited, or
otherwise exploited for any commercial purpose without our express written
consent.
You
may not frame or use framing techniques to enclose any trademark, logo, or
other proprietary information (including images, text, page layout, or form) of
Marhaba Services or Dnata or any other member of the Emirates Group without our
express written consent. You may not use any meta tags or any other
"hidden text" utilising Marhaba Services’ or Dnata’s or any other
member of the Emirates Group’s names or trademarks without our express written
consent. Any unauthorised use terminates the permission or license granted by
us.
If you wish to make any use of material on our Website or referenced in the
Booking Engine other than as set out above, please address your request to marhabasales@emirates.com.
Your
conduct
You
must not use the Website in any way that causes, or is likely to cause, the
Website or access to it to be interrupted, damaged or impaired in any way.
You
understand that you, and not Marhaba Services or Dnata, are responsible for all
electronic communications and content sent from your computer to us and you
must use the Website for lawful purposes only.
You
must not use the Website for any of the following:

for fraudulent purposes, or in connection with a criminal offence or other unlawful activity.

to send, use or reuse any material that is illegal, offensive, abusive, indecent,
defamatory, obscene or menacing; or in breach of copyright, trademark, confidence, privacy or any other right;

to comply with the terms and conditions constitutes a material breach and may
result in our taking all or any of the following actions:

Use of Booking Engine
Bookings made by you
through our Website using the Booking Engine are governed by these terms and
conditions and the Marhaba Services Corporate Membership Terms & Conditions
(the “Booking Conditions”). You
must read the Booking Conditions and click the “I agree to all terms an
conditions” button prior to using the Marhaba Services. If you fail to click the button and continue
to use the Marhaba Services, you will be deemed to have accepted the Booking
Conditions on behalf of yourself and any person for whom you have made a
booking.
In the event that your
Corporate Membership of Marhaba Services expires or is terminated for any
reason, your Website access and password will be deactivated on the effective
date of such expiry or termination.
Data Protection
Where you input data into the
Booking Engine on behalf of someone else, you confirm that you have obtained
their consent to do so, and that they have not objected to the uses of their
personal information for the purpose of a booking made through the Booking
Engine. You also confirm that, in relation to any personal or other details
relating to your employees or customers or their families in your possession you
shall, at all times, process such data in compliance with any applicable data
protection legislation in your country.
Please view the Emirates Group Privacy Policy which sets out how
we use and handle personal information.
You agree to indemnify
us for any costs, liabilities and losses whatsoever incurred by us arising out
of any action or inaction by you that result in us being in breach of any
provisions of applicable data protection legislation in your country.
Entire Agreement
These terms and conditions and the Booking
Conditions and any document expressly referred to in them represent the entire
agreement between you and us and supersede any prior agreement, understanding
or arrangement between us, whether oral or in writing.
Jurisdiction and Applicable Law
These terms and conditions are governed by the law of and
applicable in the Emirate of Dubai. The Dubai courts will have non-exclusive
jurisdiction over any claim arising from, or related to, a visit to our Website
although we retain the right to bring proceedings against you for breach of
these conditions in your country of residence or any other relevant country.
